Welcome to Elegenze. These Terms of Service form a legally binding agreement between you and Elegenze, a brand operated by Gardashov LLC, governing your access to and use of elegenze.com and all related products and services. By using the Site or placing an order, you agree to these Terms.
1. Agreement to Terms
These Terms apply to all visitors, users, and customers of the Site. By using the Site, you affirm that the information you provide is accurate and that you will use the Site only in accordance with these Terms and all applicable laws. We reserve the right to deny access to anyone at any time for any lawful reason.

5. Products and Descriptions
We make every reasonable effort to display and describe our products accurately. However, we cannot guarantee that colors and details shown on your device will be perfectly accurate. Slight variations in color, texture, and appearance may occur and are not considered defects. Sizing may vary between styles.
6. Pricing, Taxes, and Currency
All prices are displayed in Australian dollars (AUD). GST is included in all displayed prices where applicable. Prices are subject to change without notice. If a product is listed at an incorrect price due to an error, we reserve the right to refuse or cancel any order and will issue a full refund if payment has been processed.
7. Orders and Payment
By submitting an order, you make an offer to purchase the selected products subject to these Terms. Our acceptance of your order occurs only when we ship the products to you. We accept the payment methods displayed at checkout. All payment information is processed by PCI-compliant third-party processors — we do not store complete payment card numbers. We reserve the right to refuse, limit, or cancel any order for any lawful reason including product unavailability, pricing errors, or suspected fraudulent activity.
8. Promotions and Discounts
Promotional codes and discounts cannot be combined unless expressly stated, are valid for a limited time, and may be modified or discontinued at any time. We reserve the right to cancel any order where a code has been used fraudulently or in violation of its terms.
9. Shipping and Delivery
Processing times, estimated delivery windows, shipping rates, and tracking details are described in our Shipping Policy, incorporated into these Terms by reference. Delivery estimates are not guaranteed. Title and risk of loss pass to you upon our delivery of the products to the carrier.
10. Returns, Refunds, and Exchanges

11. Intellectual Property
All content on the Site including text, images, logos, designs, and the overall look and feel is owned by or licensed to Elegenze and Gardashov LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or exploit any content without our prior written consent. "Elegenze" and our logos and product names are trademarks of Elegenze or Gardashov LLC.
12. User Content
By submitting reviews, photos, or other content, you grant Elegenze a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with our business and marketing. We are not obligated to publish or retain any user content and may remove it at our discretion.
13. Prohibited Uses
You agree not to use the Site in violation of any applicable law or these Terms, infringe or misappropriate the intellectual property or other rights of any party, provide false or fraudulent information or impersonate any person, upload or transmit viruses or any malicious code, attempt to gain unauthorized access to the Site or our systems, use any automated means to access the Site or collect data without permission, interfere with or disrupt the Site or its infrastructure, or resell or commercially exploit any portion of the Site without authorization.

The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for their content, accuracy, or practices. Your use of any third-party service is at your own risk.
15. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site, Services, and all Products are provided on an "as is" and "as available" basis, without warranties of any kind. We do not warrant that the Site will be uninterrupted, secure, accurate, or free of errors.
16. Limitation of Liability
To the fullest extent permitted by law, Elegenze, Gardashov LLC, and their affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, Services, or Products. Our total aggregate liability shall not exceed the greater of the amount you paid for the product giving rise to the claim or fifty Australian dollars (AUD $50).

You agree to defend, indemnify, and hold harmless Elegenze, Gardashov LLC, and their affiliates from and against any claims, liabilities, damages, losses, costs, and expenses arising out of your use of the Site, violation of these Terms, or violation of any applicable law or the rights of any third party.

Your use of the Site is governed by our Privacy Policy, incorporated into these Terms by reference. By using the Site, you consent to the practices described in our Privacy Policy.
19. Force Majeure
We will not be liable for any failure or delay in performing our obligations resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, governmental actions, power outages, or carrier failures.
20. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Florida and applicable United States federal law. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
21. Dispute Resolution and Arbitration
Before bringing any formal claim, you agree to first contact us at support@elegenze.com and attempt in good faith to resolve the dispute informally. If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court where eligible. You and Elegenze agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Any claim must be brought within one year after the cause of action arises, or it is permanently barred.
22. Termination
We may suspend or terminate your access to the Site at any time and at our sole discretion, with or without notice, including for any violation of these Terms.
23. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not be deemed a waiver of that right. These Terms, together with our Privacy Policy, Shipping Policy, and Returns and Refunds Policy, constitute the entire agreement between you and Elegenze regarding your use of the Site.
